Whether or not the nurse acted with reckless conduct can be determined by examining the event closely and asking the following questions:

  1. Was the risk taken by the nurse "substantial"?

  2. Was it "unjustified"?

  3. Did the nurse act in "conscious disregard of the risk"?

If the answer to these three questions is "yes," then the nurse was reckless toward injury or potential injury to the patient and disciplinary action is warranted.
